Elected politicians—legislators and, in some systems, members of the executive—can choose to exercise authority themselves or to delegate that authority to any number of agencies. Such delegation of power can occur at the constitutional stage, but is most common at the post-constitutional stage. Two categories of delegation can be distinguished: domestic delegation to agencies within the legislators’ jurisdiction, and international delegation to supranational or international bodies. While some research has been done on domestic delegation, especially in the context of delegation (...) to administrative agencies in the U.S., as well as on delegation to supranational bodies, especially with regard to the E.U., these activities have not been analyzed within a unified framework. This paper attempts to inquire into these issues and provide a general picture of the decision-making process regarding whether to delegate authority and to which body to transfer the authority. The past decade has been a period of rapid change in Central and Eastern Europe. Almost all of these countries have either passed entirely new constitutions or substantially modified the old ones. This is a unique situation in which constitutional delegation of powers can be performed almost simultaneously with post-constitutional delegation. The constitutional process in Israel is very different. It has been underway for fifty years. However, it can also be characterized by simultaneous constitutional and post-constitutional choices. In this paper, we examine such delegation choices in nine countries. We describe the main differences among these countries with regard to delegation of power, try to trace their origins and analyze their effects on delegation of powers. One question raised is what are the ramifications of a quasi-simultaneous constitutional and post-constitutional choice? Have constitutional rules been chosen in anticipation of the necessary compatibility with the rules of international organizations that one wants to join? Has membership in international organizations led to a boost in credibility of those governments concerned? (shrink)

A wide-ranging history of the intellectual developments that produced the modern idea of the algorithm. Bringing together the histories of mathematics, computer science, and linguistic thought, Language and the Rise of the Algorithm reveals how recent developments in artificial intelligence are reopening an issue that troubled mathematicians long before the computer age. How do you draw the line between computational rules and the complexities of making systems comprehensible to people? Here Jeffrey M. Binder offers a compelling tour of four (...) visions of universal computation that addressed this issue in very different ways: G. W. Leibniz's calculus ratiocinator; a universal algebra scheme Nicolas de Condorcet designed during the French Revolution; George Boole's nineteenth-century logic system; and the early programming language ALGOL, whose name is short for algorithmic language. These episodes show that symbolic computation has repeatedly become entangled in debates about the nature of communication. To what extent can meaning be controlled by individuals, like the values of a and b in algebra, and to what extent is meaning inevitably social? By attending to this long-neglected question, we come to see that the modern idea of the algorithm is implicated in a long history of attempts to maintain a disciplinary boundary separating technical knowledge from the languages people speak day to day. Machine learning, in its increasing dependence on words, now places this boundary in jeopardy, making its stakes all the more urgent to understand. The idea of the algorithm is a levee holding back the social complexity of language, and it is about to break. This book is about the flood that inspired its construction. (shrink)

Scholars in both digital humanities and media studies have noted an apparent disconnect between computation and the interpretive methods of the humanities. Alan Liu has argued that literary scholars employing digital methods encounter a “meaning problem” due to the difficulty of reconciling algorithmic methods with interpretive ones. Conversely, the media scholar Friedrich Kittler has questioned the adequacy of hermeneutics as a means of studying computers. This paper argues that that this disconnect results from a set of contingent decisions made in (...) both humanistic and mathematical disciplines in the first half of the nineteenth century that delineated, with implications that continue to resonate in the present day, which aspects of human activity would come to be formalized in algorithms and which would not. I begin with a discussion of Nicolas de Condorcet, who attempted, at the height of the 1789 revolution, to turn algebra into a universal language; his work, I argue, exemplifies the form of algorithmic thinking that existed before the Romantic turn. Next, I discuss William Wordsworth’s arguments about the relationship of poetry and science. While Wordsworth is sometimes viewed as a critic of science, I argue that his polemic is specifically targeted at highly politicized projects like Condorcet’s that sought to supplant existing modes of thought with scientific rationality. Finally, I demonstrate the importance of Romantic thought for George Boole, creator of the logic system that would eventually form the basis of digital electronics. The reason Boole was able to succeed where Condorcet had failed, I argue, was that Romantic notions of culture enabled him to reconcile a mechanical view of mathematical reasoning with an organic view of the development of meaning—a dichotomy that remains a key assumption of computer interfaces in the twenty-first century. The notion of antifragility, an attribute of systems that makes them thrive under variable conditions, has recently been proposed by Nassim Taleb in a business context. This idea requires the ability of such systems to ‘tinker’, i.e., to creatively respond to changes in their environment. A fairly obvious example of this is natural selection-driven evolution. In this ubiquitous process, an original entity, challenged by an ever-changing environment, creates variants that evolve into novel entities. Analyzing functions that are essential during stationary-state (...) life yield examples of entities that may be antifragile. One such example is proteins with flexible regions that can undergo functional alteration of their side residues or backbone and thus implement the tinkering that leads to antifragility. This in-built property of the cell chassis must be taken into account when considering construction of cell factories driven by engineering principles. (shrink)

Two decades ago, Rolf Landauer (1991) argued that “information is physical” and ought to have a role in the scientific analysis of reality comparable to that of matter, energy, space and time. This would also help to bridge the gap between biology and mathematics and physics. Although it can be argued that we are living in the ‘golden age’ of biology, both because of the great challenges posed by medicine and the environment and the significant advances that have been made—especially (...) in genetics and molecular and cell biology—we feel that information as an essential aspect of life has been neglected, or at least misunderstood. We therefore summon Maxwell’s Demon and its distant relative the ratchet, and apply these to biology. (shrink)

We apply Benacerraf’s distinction between mathematical ontology and mathematical practice to examine contrasting interpretations of infinitesimal mathematics of the seventeenth and eighteenth century, in the work of Bos, Ferraro, Laugwitz, and others. We detect Weierstrass’s ghost behind some of the received historiography on Euler’s infinitesimal mathematics, as when Ferraro proposes to understand Euler in terms of a Weierstrassian notion of limit and Fraser declares classical analysis to be a “primary point of reference for understanding the eighteenth-century theories.” Meanwhile, scholars like (...) Bos and Laugwitz seek to explore Eulerian methodology, practice, and procedures in a way more faithful to Euler’s own. Euler’s use of infinite integers and the associated infinite products are analyzed in the context of his infinite product decomposition for the sine function. Euler’s principle of cancellation is compared to the Leibnizian transcendental law of homogeneity. The Leibnizian law of continuity similarly finds echoes in Euler. We argue that Ferraro’s assumption that Euler worked with a classical notion of quantity is symptomatic of a post-Weierstrassian placement of Euler in the Archimedean track for the development of analysis, as well as a blurring of the distinction between the dual tracks noted by Bos. Interpreting Euler in an Archimedean conceptual framework obscures important aspects of Euler’s work. Such a framework is profitably replaced by a syntactically more versatile modern infinitesimal framework that provides better proxies for his inferential moves. (shrink)

Ketamine, a dissociative anesthetic commonly used by US physicians, has recently been shown to be a powerful anti-depressant and is also capable of eliciting transpersonal experiences that can be transformative. Although currently approved in the US only for use as an anesthetic, physicians there can legally prescribe it off-label to treat various psychological/ psychiatric problems and it has been used for these non-anesthetic purposes in Argentina, Iran, Mexico, Russia, and the UK, as well as in the US. The literature on (...) using ketamine psychotherapeutically is reviewed and two case studies using ketamine-enhanced psychotherapy for treating death anxiety in terminally-ill people are reported. The potential importance of beginning formal research on using KEP during end-of-life for those suffering death anxiety is emphasized. (shrink)

The aim of the present investigation was to describe and to classify significant ethical problems encountered by the members of the staff during the daily clinical work at a hospital medical department. A set of definitions was prepared for the purpose, including the definition of a 'significant ethical problem'. During a three month period 426 inpatients and 173 outpatients were admitted. Significant ethical problems were encountered during the management of 106 in-patients (25 per cent) and 9 out-patients (5 per cent). (...) No significant difference was found between the frequency of ethical problems in female and male patients, but a positive correlation was noted between the number of problems and the patients' age. The problem types were classified according to a problem list. The results of this investigation suggest that greater attention must be paid to discussions about ethical problems among doctors and other categories of health personnel and that, among others, medical students ought to be taught the analysis of ethical problems. BackgroundAlthough patient advocates have developed templates for standard consent forms, evaluating patient preferences for first in human (FIH) and window of opportunity (Window) trial consent forms is critical due to their unique risks. FIH trials are the initial use of a novel compound in study participants. In contrast, Window trials give an investigational agent over a fixed duration to treatment naïve patients in the time between diagnosis and standard of care (SOC) surgery. Our goal was to determine the patient-preferred presentation (...) of important information in consent forms for these trials.MethodsThe study consisted of two phases: (1) analyses of oncology FIH and Window consents; (2) interviews of trial participants. FIH consent forms were analyzed for the location(s) of information stating that the study drug has not been tested in humans (FIH information); Window consents were analyzed for the location(s) of information stating the trial may delay SOC surgery (delay information). Participants were asked about their preferred placement of the information in their own trial’s consent form. The location of information in the consent forms was compared to the participants’ suggestions for placement. Results34 [17 FIH; 17 Window] of 42(81%) cancer patients approached participated. 25 consents [20 FIH; 5 Window] were analyzed. 19/20 FIH consent forms included FIH information, and 4/5 Window consent forms included delay information. 19/20(95%) FIH consent forms contained FIH information in the risks section 12/17(71%) patients preferred the same. Fourteen (82%) patients wanted FIH information in the purpose, but only 5(25%) consents mentioned it there. 9/17(53%) Window patients preferred delay information to be located early in the consent, before the “Risks” section. 3/5(60%) consents did this.ConclusionsDesigning consents that reflect patient preferences more accurately is essential for ethical informed consent; however, a one-size fits all approach will not accurately capture patient preferences. We found that preferences differed for FIH and Window trial consents, though for both, patients preferred key risk information early in the consent. Next steps include determining if FIH and Window consent templates improve understanding. (shrink)

A great fissure occurred in Western civilization in the early modern period with the divorce between the humanities and the sciences and the rise of scientific naturalism. The Metaphysics of Self and World is a philosophical exploration of the relationship between the individual, the culture, and the world. It is, in the author's words, "a philosophy of the humanities, a philosophy of humanity, and a philosophy of social reality." It explores the implications of a world-view that would integrate the perspective (...) of the sciences with humanistic ways of thought. E.M. Adams claims that we do violence to ourselves as human beings by trying to fit into the world as delineated in scientific categories. Rejecting cultural subjectivism and scientific naturalism, he argues for the irreducibility and validity of the categories of the humanities and for a fully developed humanistic philosophy of self and world. In generating this world-view, he utilizes the humanities as a source of culture therapy in order to close the fissure in Western civilization. Author note: E. M. Adams is Kenan Professor of Philosophy, Emeritus, at the University of North Carolina, Chapel Hill. I would expect many readers of my book to want to agree with either Mark Heller or Alan Sidelle. The very idea of “rational constraints on lexicons” will immediately suggest to many people that either the constraints are of a purely pragmatic nature or there really are no such constraints. I can take some cold comfort in the fact that many philosophers will join me in rejecting, and many others will join me in rejecting, but since I have nothing to (...) offer in place of these positions—except mystification—I’m afraid that few will join me in rejecting both of them. In recent years it has been convincingly argued that the Church-Turing thesis concerns the bounds of human computability: The thesis was presented and justified as formally delineating the class of functions that can be computed by a human carrying out an algorithm. Thus the Thesis needs to be distinguished from the so-called Physical Church-Turing thesis, according to which all physically computable functions are Turing computable. The latter is often claimed to be false, or, if true, contingently so. On all accounts, (...) though, thesis M is not easy to give counterexamples to, but it is never asked why—how come that a thesis that transfers a notion from the strictly human domain to the general physical domain just happens to be so difficult to falsify. In this paper I articulate this question and consider several tentative answers to it. (shrink)

Since 9/11, citizens of all nations have been searching for a democratic public philosophy that provides practical and inspiring answers to the problems of the twenty-first century. Drawing on the wisdom of past and present pragmatist thinkers, Judith M. Green maps a contemporary form of citizenship that emphasizes participation and cooperation and reclaims the critical role of social movements and nongovernmental organizations.
